Marketplace Code of Conduct
ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE
Kaastor.com ("Kaastor", the "Service"), owned and operated by Hobbista, Inc. ("Hobbista"), is provided to you ("Buyer", "Buyers", "Seller", "Sellers", "Users", "User", "Member", "Members") under the Terms of Service (TOS) described in the Terms and Conditions section and this Code of Conduct and any operating rules or policies that may be published by Kaastor. The TOS and this Code of Conduct comprises the entire agreement between Buyer and/or Seller and Kaastor and supersedes all prior agreements between the parties regarding the subject matter contained herein. BY USING THE KAASTOR WEBSITE, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE TOS and the Code Of Conduct. Buyers and/or sellers that do not comply with the TOS and Code of Conduct will be blocked from using the Kaastor Marketplace.
1) Listing an Item
Lists in Kaastor are text descriptions, graphics and/or pictures or annotations supplied by members that describe an item you would like to sell, buy, make public or an item you may have bought or sold. These lists may yield a collection, wantlist, for sale list or any other future list or report that link users with existing items in the Kaastor database. The lists are generated by finding an existing item in the Kaastor database and adding the item to an existing list type (collection, wantlist, etc).
2) Transaction
As a seller you agree with the following terms when listing an item for sale:
a) You possess this item
b) You want to sell this item
c) The item is available
d) This item is the same as the item described in Kaastor
e) You will sell the item at the price advertised
f) You will post the item as soon as the payment is posted or cleared
As a buyer you agree to the following terms when purchasing an item:
a) You reviewed and understood all seller information and policies and agreed with them
b) You are entering into a contract with the seller
c) You are obligated to pay the seller the stated price, within a reasonable timeframe
d) You have to utilize one of the payment methods accepted by the seller
e) Please review all seller information and policies and decide if you want to do business with them. Kaastor is not responsible for, and will not mediate, any order disputes. You will be buying the item from the seller, NOT from Kaastor.
3) Communication
You will utilize the Kaastor messaging system or your email to complete the transaction, but Kaastor is not involved in the actual transaction between Buyer and Seller. It is up to the buyer and seller to manage the entire workflow, logistics, process, payment and shipping mechanisms, timeframes and any and all variables foreseen or unforeseen, directly or indirectly associated with the transaction. You can utilize the feedback system to reflect the overall satisfaction level of the transaction, but you may not take any actions which may undermine the integrity of the feedback system, such as: leaving positive feedback for yourself using secondary User IDs or third parties; leaving negative feedback for other users using secondary accounts or third parties (feedback bombing); or leaving negative feedback if a user fails to perform some action that is outside the scope of the trade (feedback extortion). If You continue to earn and maintain a negative net feedback rating, or, upon investigation, it has been determined that You have otherwise abused the feedback system, Kaastor, at its sole discretion, reserves the right to suspend your transacting privileges. Leaving vulgar, obscene, inflammatory or threatening feedback will result in your immediate suspension.
4) Kaastor Fees and commissions
It’s free to list your magazines on the Kaastor marketplace. Kaastor charges a 3.8% commission for each magazine sold through the marketplace. This fee is computed based on your selling price. Kaastor will send you an invoice at beginning of each month, which consists of the fees for the previous month. You agree to pay these fees without delay. Kaastor reserves the right to terminate an account if pending fees associated with that account are not paid within 30 days of the due date.
30% of the commission for any particular sold record will be paid out to the member who submitted the record. Commission payments will be executed once per quarter.
4) Marketplace Release
Kaastor is not involved in the actual transaction between Buyer and Seller, and we have no control over the quality, safety or legality of the items listed, or the transactions. We are not a guarantor of any transaction nor are we an escrow company. Therefore, in the event that you have a dispute with one or more members, you release Kaastor and our parent, officers, directors, agents, subsidiaries, legal representatives and employees from claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
As a Buyer or Seller you agree that this transaction will be a private sale between yourself and the buyer. You hold Kaastor immune to any claim of damages, loss, or inconvenience howsoever caused. Kaastor is not responsible for, and will not mediate, any order disputes. You will be selling directly to Kaastor users, NOT via Kaastor.
